Websites & WordPress
Once we are finished building your website in WordPress (if applicable), you will be responsible for any updates that may require you to lose customization, updates to themes, and for any lose that may happen as a result of updates to your website/server/files. Clients are responsible for making sure WordPress is updated and all the security measures are in place to protect your website files, database, server, and any data you have on your hosting account. If you require backups for database or website files, you are further responsible for this action unless a contract is in place for Jakim Sarazin to do this for you. Any issue that may result in a loss of files or database tables or files, we are not responsible for and you will hold Jakim Sarazin (easywebservice.ca) responsible for any actions as a result of having a hosting, word press, or website created by us.
Administering the Service Website Software & C-Panel – Your Administrative Responsibilities
When using our service, you will be given select administrative access to your website hosting account. You should read and understand the sections in the software user manuals about administration. It is your responsibility to administer the hosting account as if you were running it yourself.
We are not responsible for setting up software that may or may not be in your C-Panel and you are responsible for such services such as website builders, templates, scripting, word press, and all other software that may or may not come with your hosting package. We are responsible for making sure your hosting has no issues and if issues due arise such as down times, we will correct these issues as fast as we can and you understand that things happen and that we are NOT responsible for your software, add-on’s, or any other language or coding you might install on your hosting. We will do our best to make sure your hosting is up and running smoothly. For any reason your hosting goes down, client agrees not to hold Jakim Sarazin responsible for this down time. Having said that, please feel free to call us anytime and if we can assist you in any way to our knowledge, we will certainly do so.
Remember that your materials will be hosted on a publically accessible server. You are responsible for security of your hosting account / website. In particular, Canada Reseller Hosting and Jakim Sarazin provides facilities, described in the user manuals, for restricting who can access a site, modify a site, and how it can be accessed. Any software or scripts you upload to your hosting account or server (including any software or scripts contained within your hosting account or server) must be secure and must not allow remote access via css (cross site scripting) or vulnerable / insecure coding. Any website, hosting account or server found hosting insecure software or scripts will be suspended or terminated with or without notice. Any website, hosting account or server with insecure passwords will be suspended or terminated with or without notice.
When you purchase a domain name with us, we will do our best to make sure we register it as soon as possible. If for some reason when we register it on your behalf, the domain is taken, we are not responsible for this action and you agree that we acted on the best interest of you the customer and we did it within a timely matter. If for some reason there is also a time delay between you buying the domain name and Jakim Sarazin not getting to register it in time, things happen such as life and we are not responsible for this. If at any time you buy a domain name from us and we do not register it before someone else does, we are NOT responsible for this and we will refund you amount paid for the domain at the cost you paid for it. If for some reason it was a package deal, the refund will be the price set in the package and not the retail price.

The client is responsible for making sure all the security measures are in place to protect website files, databases, server, users, emails and any other data on the hosting account. Client is responsible for all backups including but not limited to SQL database, website files, emails. Client is responsible for any actions. Client is responsible for any issue that may result in a loss of files or database tables or files, emails or any other service provided or not. Jakim Sarazin is not responsible for any price displayed on your website. Client agrees to verify content and verify for errors and omissions. Unless otherwise specified the client is responsible for providing white background images of the products and items to be listed.
As a client of Jakim J Sarazin for web design and development or for any other service related to our business or for any product such as domain names or website hosting, we are not responsible for any security issues that happens to your website, hosting, domain name, computer, or any other products or services we provide to you. You will not come back on Jakim Sarazin for anything related to our products and services. You agree that we will do our best to provide to you the best level of service and best products as we can humanly provide to you. You also agree that you are responsible for all your products and services and also your privacy and Jakim Sarazin is not responsible.
Renewal or Transfers
Client agrees that renewal of domain name and website hosting can be up to $250 per year (2016) and there is no obligation to renew and you may opt-out or cancel any time before renewal and you still own your website. If client decides to change or transfer hosting provider he or she is responsible for the transfer of the website files and any Sql databases. Jakim Sarazin is not responsible for any domain or hosting transfer unless transfer is specified in the proposal.
All end-products are sold ‚as is‛ on a pre-paid basis. Client assumes the responsibility for the purchase, and no refunds will be issued. You may cancel or op-out of renewal at anytime. If you decide to change your hosting you will be responsible for the transfer of your website files and Sql databases. We are not responsible for transfers or any data loss in the process.
End-products related to emails are on a self-serve basis. Jakim Sarazin is not responsible for any problems with your email software or configuration including loss of password. You may logon to your C-panel to manage your email settings and accounts. Client is responsible to comply with Canadian Spam Laws.
Unsolicited Email / SPAM Email or Bulk Email
a. Unsolicited email, spam email or bulk emailing is not permitted within any of our hosting products / services. The use of Canada Reseller Hosting servers or networks to transmit unsolicited email, spam email or bulk email is strictly forbidden. Under no circumstances is the transmission of unsolicited email, spam email or bulk email acceptable or tolerated.
b. Any transmission of unsolicited email, spam email or bulk email from our servers or networks can cause irreparable monetary damages. All damages caused by unsolicited email / spamming will be prosecuted to the fullest extent of the law.
c. Any client caught explicitly spamming, sending unsolicited email or bulk email from our servers or networks will have their account immediately suspended or terminated without notice.
d. Jakim Sarazin reserves the right to cancel, suspend or terminate any website, hosting account, reseller account or server for any transmission of unsolicited email, spam email or bulk email from our network without prior warning or notification.
Maintenance will only exist when specified in the ‘Offer’. Time will be deducted by 15 minute increments. Maintenance can be used to change: sliders, add posts, add media, monthly backups, basic seo, and email support (but not limited). You are responsible to supply media or posts in both official languages (if applicable). Maintenance does not include the creation of content or media. Off-site time begins from business location and resumes when going back. Easy maintenance can be updated within 1 hour to 48 hours. More complex integration and off-site visits are determined on a per case basis and cannot guaranty dates in advance unless specified in the proposal.
Deposit & Payment & Timeline
All end-products are sold on a pre-paid basis and are not refundable. Deposits are required to secure the transaction and act as a contract between client and Jakim Sarazin. Deposits are not refundable. Balance is due 4 weeks to the date of deposit. If client payment is processed with MasterCard or Visa a 2.75% service fee will be added. Timeline advertized in this proposal are supplied in good faith but are subject to forces unknown and could be retarded due to unforeseen issues but not limited. The client shall be entitled to full ownership of all final artwork, website and other end-products created during the project upon full payment of the agreed fee.
